Sandro Muhlach’s Accused Rapists Deny the Charges in a Joint Statement

Independent GMA contractors Jojo Nones and Richard Cruz filed a joint counter-affidavit against Sandro Muhlach’s rape complaint before the Department of Justice (DOJ) on Thursday, September 12.

Nones and Cruz claimed that there was not enough evidence to charge them with rape through sexual assault due to the inconsistencies in Muhlach’s testimony.

Additionally, Maggie Abraham-Garduque, the pair’s lawyer, mentioned that Sandro Muhlach’s drug test came out negative. To recall, Muhlach mentioned on August 27 that he was forced by Nones and Cruz to use illegal substances before sexually assaulting him.



In their counter-affidavit, Jojo Nones and Richard Cruz also pointed out that Muhlach’s testimony doesn’t mention any allegations that an object was inserted into the actor’s mouth or anal orifice.

“There is nothing in the testimonial evidence of the complainant which states of any allegation that a penis or object/instrument was inserted in his mouth or anal orifice,” the respondents said.

“That complainant alleged that tongue is considered as an object or instrument. However, jurisprudence declared that for tongue to be considered as object or instrument, it must be inserted into the genital or anal orifice of the alleged victim,” the counter-affidavit added.

Garduque then presented Sandro Muhlach’s medicolegal result, confirming that no object was inserted into the actor’s anal orifice. Furthermore, she also mentioned the call logs between the actor and his girlfriend during the time of the sexual abuse.



“This means na during the time na nasa kwarto siya, wala pong restraint. ‘Yun po ang gusto namin patunayan,” Garduque said.

In an interview, Garduque told reporters that the DOJ panel moved the case for resolution since Muhlach’s camp will no longer file a reply. “Submitted na po for resolution ang kaso,” Garduque said.



Sandro’s father, Nino Muhlach, also at the DOJ, said his son cried after the meeting. “Galit syempre. Umiyak siya sa loob,” he said. He also added that they were hoping to move the case forward.
